Terms of Use
These Terms of Use ("Terms") are an agreement between you and [9VIL LEGAL ENTITY] ("9vil", "we", "us") for the 9POS mobile app and website (together, the "Service"). By installing or using the Service you agree to these Terms. If you do not agree, do not use it.
1. The Service
9POS is a point-of-sale app for small shops that works on your device. Selling, stock, customers, reports and printing over Bluetooth run on your device and work without a connection. Downloading the app, opening links and sharing files need your device's connection. We may improve, change or remove features over time.
2. Licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for lawful purposes and subject to these Terms and the app store's usage rules. You may not copy, modify, reverse engineer, decompile or resell the App except as the law allows, or remove notices from it.
3. Your data
You keep all rights to the data you enter and create: products, sales, customers, photos and settings. It is stored on your device and we do not access or receive it. You are responsible for having the right to store information about your customers and for complying with the laws that apply to your business, including tax, invoicing, receipt and consumer-protection rules in your country.
4. You are responsible for backups
Because there is no account and no cloud copy, we cannot recover your data. If you lose, reset or replace your device without a backup, the data is gone. Create backups regularly from More, Backup and restore, and keep the files somewhere safe. Restoring a backup replaces the data currently in the App.
5. Accuracy and your accounts
9POS calculates totals, tax, change, stock and reports from what you enter. Check them before relying on them for your books, taxes or legal records; reports and receipts from the App are tools to help you, not accounting or tax advice, and may not meet the legal receipt or invoicing requirements of your country. Estimated profit depends on the cost prices you enter.
6. Free to use
The App is free. We do not currently charge for any feature. If that ever changes we will say so clearly in the App and on this website before it takes effect, and the features you already use on your device will not be taken from you without notice.
7. Payments between you and your customers
9POS does not process payments, hold money or act as a payment provider. Cash, card, bank transfer and QR payments happen outside the App, between you, your customer and your bank or payment provider. The App only records the method you choose. A QR image you add is yours; make sure it points to your own account.
8. Acceptable use
Do not use the Service to break the law, to sell goods or services you are not allowed to sell, to infringe other people's rights, to attempt to disrupt or reverse engineer the Service, or to send us unlawful content.
9. Third-party services and hardware
You may use the App with third-party hardware (printers, scanners) and services (your cloud drive, your bank's QR, your email app). We do not control them and are not responsible for them. Printer and scanner compatibility varies by model; we cannot guarantee that a given device will work.
10. Intellectual property
The App, the 9POS name and logo, and this website belong to 9vil or its licensors. These Terms give you no ownership of them. The Be Vietnam Pro font is used under the SIL Open Font Licence.
11. Disclaimer
The Service is provided "as is" and "as available", without warranties of any kind, to the extent the law allows. We do not promise that it will be uninterrupted or error-free or that it fits a particular purpose.
12. Limitation of liability
To the extent the law allows, 9vil is not liable for indirect, incidental or consequential loss, including lost sales, lost profit or lost data, arising from your use of the Service. Nothing in these Terms limits liability that cannot be limited by law or any mandatory consumer right you have.
13. Termination
You can stop using the Service at any time by uninstalling the App. We may suspend or end access if you breach these Terms. Sections that by their nature should survive will survive.
14. Changes
We may update these Terms. The date at the top shows the latest version. If a change is material we will give notice in the App or on this site. Continuing to use the Service after a change means you accept it.
15. Governing law
These Terms are governed by the laws of [JURISDICTION], without limiting any mandatory consumer rights you have in your country.
